Decision of the Standing Committee of the National People's Congress on Formulation of Supervisory Regulations by the National Supervisory Commission

(Adopted at the 14th Meeting of the Standing Committee of the Thirteenth National People's Congress on October 26, 2019)

For the purpose of implementing the Constitution and the Supervision Law of the People's Republic of China, ensuring that the National Supervisory Commission performs the functions and duties of the highest-level supervisory organ according to law, the Standing Committee of the Thirteenth National People's Congress has decided as follows based on the actual need of supervisory work:

1. National Supervisory Commission shall formulate supervisory regulations in accordance with the Constitution and the laws.

Supervisory regulations may stipulate on the following matters:

(1) for the need of implementing the provisions of law; and

(2) for the need of performing the duty of leading the work of local supervision commissions at various levels.

Supervisory regulations shall not be in contravention with the Constitution or the laws.

2. Supervisory regulations shall be subject to the decision of the plenary meeting of the National Supervision Commission, and be made public by announcement of the National Supervision Commission.

3. Within 30 days after being announced, the supervisory regulations shall be submitted to the Standing Committee of the National People's Congress for the record.

The Standing Committee of the National People's Congress has the power to repeal the supervisory regulations that are in contravention with the Constitution or a law.

This Decision shall come into force as of October 27, 2019.
