Top legislature clarifies supervisory commission's power to formulate supervisory regulations

BEIJING -- The Standing Committee of the National People's Congress (NPC), the top legislature, adopted a decision of clarifying the National Supervisory Commission's (NSC) power to formulate supervisory regulations at the closing meeting of its bimonthly session Saturday.

The NSC formulates supervisory regulations in accordance with the Constitution and laws, according to the decision which will go into effect from Oct. 27.

Meanwhile, the decision specifies the scope of supervisory regulations formulated by the NSC, stipulating that supervisory regulations can be made to enforce the provisions of the laws or to fulfill the responsibility of leading local supervisory commissions.

"Supervisory regulations shall not contravene the Constitution or the laws," said the decision.

It also spells out the procedures the NSC should follow in rule making. Supervisory regulations shall be decided by the plenary session of the NSC and promulgated by the commission in public announcements.

Moreover, the supervisory regulations shall be reported to the NPC Standing Committee for the record within 30 days after their promulgation, said the decision, adding the NPC Standing Committee has the power to repeal regulations that contravene the Constitution and the laws.
