Decision of the Fifth Session of the Thirteenth National People's Congress on the Number of Deputies to the Fourteenth National People's Congress and the Election of the Deputies

Pursuant to relevant provisions of the Constitution of the People's Republic of China and the Electoral Law of the National People's Congress and Local People's Congresses of the People's Republic of China, the Fifth Session of the Thirteenth National People's Congress decides on the number of deputies to the Fourteenth National People's Congress and the election of the deputies as follows:

1. The number of deputies to the Fourteenth National People's Congress shall not exceed 3,000 deputies.

2. The number of deputies to the Fourteenth National People's Congress to be elected from a province, autonomous region, or municipality directly under the Central Government shall be the number calculated on the basis of the population of each province, autonomous region, and municipality directly under the Central Government, plus the base number which is the same for each province, autonomous region, and municipality directly under the Central Government, and plus the number otherwise allocated. 

(1) Among all deputies to the Fourteenth National People's Congress, there shall be 2,000 deputies allocated according to the population. One deputy shall be allocated for approximately every 700,000 people in a province, autonomous region, or municipality directly under the Central Government;

(2) The base number of deputies of a province, autonomous region, or municipality directly under the Central Government shall be eight; and

(3) The number of deputies to be elected from a province, autonomous region, or municipality directly under the Central Government as otherwise allocated shall be separately allocated by the Standing Committee of the National People's Congress according to the law.

3. The number of deputies to the Fourteenth National People's Congress to be elected by the Hong Kong Special Administrative Region shall be 36, and the number of deputies to the Fourteenth National People's Congress to be elected by the Macao Special Administrative Region shall be 12, and the measures for election of these deputies shall be separately formulated by the National People's Congress.

4. For the time being, 13 deputies to the Fourteenth National People's Congress representing Taiwan Province shall be elected from among people of Taiwan origin in the other provinces, autonomous regions, and municipalities directly under the Central Government and in the Chinese People's Liberation Army. The measures for election of these deputies shall be formulated by the Standing Committee of the National People's Congress. Certain number of seats shall be reserved for the election of more deputies in accordance with law.

5. The number of  deputies to the Fourteenth National People's Congress to be elected from among the Chinese People's Liberation Army and the Chinese People's Armed Police Force shall be 278.

6. The number of deputies to the National People's Congress to be elected from among the ethnic minorities shall be in the neighborhood of 12 percent of the total number of deputies. A minimum of one deputy to the National People's Congress shall be elected from each of the ethnic minorities that has a very small population.

7. The number of deputies to the Fourteenth National People's Congress representing those overseas Chinese who have returned to the motherland shall be 35.  

8. In principle, the percentage of female deputies to the Fourteenth National People's Congress shall be higher than that of the Thirteenth National People's Congress.

9. Among all deputies to the Fourteenth National People's Congress, the percentages of grassroots deputies, especially those who are frontline workers, farmers and professional technical personnel, shall be greater than those to the Thirteenth National People's Congress, and there shall be a proper increase in the number of deputies who are migrant workers. The percentage of deputies who are Party and government leaders and cadres must continue to be strictly controlled. There shall also be a certain percentage of re-elected deputies.

10. Deputies to the Fourteenth National People's Congress shall be elected in January 2023.
